Welcome to NailGlow Supplies.

The terms “we”, “us” and “our” refer to NailGlow Supplies. We operate this online store and website, including its information, content, features, products and related services.

These Terms of Service, together with the policies referred to in them, explain the conditions that apply when you access our website, create a customer account or purchase products from us.

By accessing or using our website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use our website or services.

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, including rights available under the Australian Consumer Law.

1. Eligibility and customer accounts

You must have the legal capacity to enter into a contract to place an order through our store.

When you provide information to us, including your name, email address, billing information, shipping address and payment details, you agree that the information is accurate, complete and current.

You are responsible for maintaining the security of your email account, sign-in codes and other authentication information used to access your customer account.

You must notify us promptly if you believe your customer account has been accessed without authorisation.

Customer accounts are provided for your use and must not be sold, transferred or used to impersonate another person.

2. Online-only store

NailGlow Supplies is an online-only store.

We do not offer walk-in shopping, local collection or in-person returns unless expressly arranged with us in advance.

Our fulfilment location is not open to the public. Products must not be returned to an address without first contacting us and receiving return instructions.

3. Products and professional use

NailGlow Supplies sells nail products, tools, equipment and salon supplies for personal and professional use.

Some products are intended for use by trained nail technicians or beauty professionals. You are responsible for:

• Reading and following product labels and manufacturer instructions.
• Using products only for their intended purpose.
• Following applicable workplace, hygiene and safety requirements.
• Reviewing ingredients and Safety Data Sheets where relevant.
• Ensuring you have the appropriate knowledge, training or competence to use professional products.
• Performing patch or sensitivity testing where recommended by the manufacturer.
• Stopping use and seeking appropriate advice if irritation, sensitivity or an unexpected reaction occurs.
• Storing products safely and in accordance with manufacturer instructions.

Information provided on our website is general product information. It is not medical, dermatological or other professional health advice.

Product results may vary depending on preparation, application technique, curing equipment, product compatibility, storage conditions and individual circumstances.

Nothing in this section limits your rights where a product is faulty, unsafe, materially different from its description or otherwise fails to meet a consumer guarantee.

4. Electrical and battery-operated products

Electrical, rechargeable and battery-operated products must be used, charged and stored in accordance with the manufacturer’s instructions.

Use only the supplied charger, cable or power adaptor, or another replacement expressly confirmed as compatible by the manufacturer.

Do not use equipment that appears damaged, overheats, has a swollen battery or has damaged cables, plugs or connections.

Nothing in this section limits any rights relating to faulty or unsafe products under applicable consumer law.

5. Product images, colours and descriptions

We make reasonable efforts to ensure that product images, colours, descriptions and specifications are accurate.

Product colours, opacity, shimmer, finish and undertones may vary depending on:

• Screen calibration and device settings.
• Lighting and photography.
• Application technique.
• The number and thickness of coats applied.
• The colour of the underlying nail or product.
• Normal differences between manufacturing batches and raw materials.

Online images should therefore be treated as a guide rather than a guaranteed exact colour match.

Product packaging, labels, colours or specifications may occasionally be updated by a manufacturer. Where a change materially affects the product, we will take reasonable steps to update the listing.

Nothing in this section permits us to supply a product that is materially different from its description or removes any rights available under applicable consumer law.

6. Product availability

Products and quantities are subject to availability.

We may:

• Discontinue or change a product.
• Limit the quantity available to a customer.
• Restrict sales to particular locations.
• Correct product information where an error is identified.
• Restrict a product from international delivery because of carrier, customs, dangerous-goods or legal requirements.

Adding a product to your cart does not reserve the product.

7. Orders and acceptance

Placing an order is an offer to purchase products from NailGlow Supplies.

An automated order-confirmation email acknowledges that we have received your order. It does not necessarily mean that we have accepted it.

We may decline, modify or cancel an order before dispatch where reasonably necessary, including because of:

• Product unavailability.
• An obvious pricing or product-information error.
• Suspected fraud or unauthorised payment.
• An incorrect, incomplete or undeliverable address.
• Product safety, customs or shipping restrictions.
• An unusually large quantity that appears intended for unauthorised resale.
• A technical or inventory error.

If we cancel an item after receiving payment, we will refund the amount paid for the cancelled item to the original payment method.

Please review your order carefully before submitting it. Order changes and cancellations are not guaranteed after processing or packing has started.

Your rights relating to returns, refunds, faulty products and cancellations are explained in our Returns, Refunds and Cancellations Policy.

8. Related orders, purchase limits and fraud prevention

To enforce reasonable purchase limits, prevent fraud, protect available inventory or prevent unauthorised resale, we may consider related orders placed using the same:

• Customer account.
• Email address.
• Payment method.
• Billing address.
• Shipping address.
• Device or other fraud-prevention indicator.

Where we cancel an affected item after payment has been received, we will refund the cancelled amount to the original payment method.

We will not use this provision to remove any right or remedy available under applicable law.

9. Prices, GST and payments

Prices displayed for Australian customers are in Australian dollars and include GST where applicable, unless clearly stated otherwise.

Shipping charges are displayed separately during checkout before you place your order.

Customers purchasing through another active international market may see prices in another currency. Currency conversion, rounding and payment-provider charges may apply.

International customers may be responsible for customs charges, duties, import taxes or other government charges unless those amounts are expressly collected during checkout.

Prices, promotions and discounts may change without notice. The applicable product price is the price displayed when the order is submitted, subject to the correction of obvious errors.

You agree that:

• You are authorised to use the payment method provided.
• Your payment and billing information is accurate.
• Sufficient funds or credit are available to complete the transaction.

Payments are processed through third-party payment providers, including Shopify Payments and PayPal where available. NailGlow Supplies does not directly receive or store complete payment-card numbers.

10. Discounts, promotions and gift cards

Discounts and promotions may be subject to separate eligibility requirements, dates, purchase thresholds, product exclusions or usage limits.

Unless expressly stated otherwise:

• Discount codes cannot be combined.
• A discount cannot be applied retrospectively after an order has been submitted.
• Promotions are subject to product availability.
• Promotional offers may be changed or withdrawn before an order is submitted.
• Obvious promotional or pricing errors may be corrected.

Gift cards are subject to any additional terms displayed when they are purchased or used.

Nothing in this section removes consumer rights relating to faulty, unsafe or incorrectly supplied products.

11. Shipping and delivery

Orders are delivered to the shipping address provided during checkout.

Processing and delivery dates are estimates unless we expressly agree to a guaranteed date. Delivery may be affected by carrier delays, weather, customs processing, public holidays, peak periods and circumstances outside our reasonable control.

We remain responsible for reasonably assisting customers with orders that are lost, damaged or unreasonably delayed. Please contact us promptly if there is a delivery problem.

Risk in physical products passes to you when the products are delivered to the nominated address or otherwise received by you or an authorised recipient.

You are responsible for providing a complete and accurate delivery address.

Where an order is returned or requires redelivery because the address provided was incorrect or incomplete, reasonable additional delivery charges may apply.

Where you provide authority to leave, you acknowledge that the carrier may leave the parcel without obtaining a signature. This does not remove any rights or remedies that cannot lawfully be excluded.

12. International orders

International product availability may be restricted because of carrier requirements, dangerous-goods rules, customs restrictions or local laws.

You are responsible for checking whether products can be lawfully imported, possessed and used in the destination country.

International delivery estimates do not include customs-processing delays.

Unless otherwise stated at checkout, customs duties, import taxes and local government charges are the customer’s responsibility. NailGlow Supplies does not control these charges.

If an international parcel is refused, abandoned or returned because the customer did not pay an applicable import charge or complete a customs requirement, reasonable return and redelivery costs may be deducted from any voluntary refund where permitted by law.

Nothing in this section removes any mandatory rights available under applicable consumer law.

13. Returns, refunds and faulty products

Returns, exchanges and change-of-mind requests are governed by our Returns, Refunds and Cancellations Policy.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Where applicable, goods must be:

• Of acceptable quality.
• Safe.
• Fit for their normal purpose.
• Fit for a specific purpose communicated before purchase where applicable.
• Consistent with their description, sample or demonstration model.

Nothing in these Terms limits a remedy available for faulty, unsafe, damaged, incorrectly supplied or materially misdescribed goods.

Consumer-guarantee rights may also apply to qualifying purchases made for business or professional use.

14. Product misuse and compatibility

To the extent permitted by law, NailGlow Supplies is not responsible for a product problem or loss caused solely by:

• Misuse or use for an unintended purpose.
• Failure to follow manufacturer instructions.
• Incorrect preparation or application.
• Improper curing or use of unsuitable equipment.
• Incompatible product combinations.
• Improper storage or exposure to unsuitable temperatures.
• Accidental damage after delivery.
• Unauthorised alteration, decanting or relabelling.
• Use of a professional product without appropriate knowledge or training.

This section does not apply where the product itself is faulty, unsafe, incorrectly described or otherwise fails to meet an applicable consumer guarantee.

15. Intellectual property

The website and its content—including the NailGlow Supplies name, logo, branding, layout, graphics, photographs, videos, written content and other materials—are owned by or licensed to NailGlow Supplies and are protected by Australian and applicable international intellectual-property laws.

You may use the website for lawful personal or business purchasing purposes.

Without prior written permission, you must not:

• Copy, reproduce or republish substantial website content.
• Use our product images or descriptions for commercial purposes.
• Alter or remove branding or copyright notices.
• Represent yourself as being employed by, associated with or authorised by NailGlow Supplies.
• Use our branding or content in a misleading manner.

Third-party product names, logos and trademarks displayed on the website remain the property of their respective owners.

16. Third-party services and links

Our website may contain links to or integrate with third-party services, including payment providers, delivery carriers, social-media platforms and Shopify applications.

Third-party services are governed by their own terms and privacy practices.

We are not responsible for third-party websites or services that we do not own or control. This does not limit any responsibility that cannot lawfully be excluded.

17. Relationship with Shopify

NailGlow Supplies is powered by Shopify, which enables us to provide the online store and related services.

Any purchase made through our store is made directly from NailGlow Supplies. Shopify is not the seller of products purchased from NailGlow Supplies and is not responsible for fulfilling our orders.

To the extent permitted by law, Shopify and its affiliates are not responsible for injury, damage or loss arising from products sold directly by NailGlow Supplies.

18. Privacy

We collect and process personal information in accordance with our Privacy Policy.

Shopify and other service providers may process information to provide website hosting, payment processing, fraud prevention, analytics, order management, customer accounts and related services.

Please review our Privacy Policy for information about how personal information is collected, used, stored and disclosed.

19. Reviews, feedback and submitted content

Where you provide a review, photograph, video, comment, suggestion or other content, you confirm that:

• You created the content or have permission to provide it.
• It is accurate to the best of your knowledge.
• It does not infringe another person’s rights.
• It is not unlawful, misleading, abusive or defamatory.
• It does not contain malicious code or another person’s confidential information.

You grant NailGlow Supplies a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display the submitted content for operating, improving and promoting the store.

Where you received a product, discount, payment or other benefit in connection with a review, you must disclose that relationship.

We may remove submitted content that breaches these Terms or applicable law.

20. Errors and corrections

We may correct typographical errors, inaccurate product information, availability errors, pricing errors or other mistakes.

Where an error affects an order already submitted, we may contact you to confirm whether you wish to proceed using the corrected information or cancel the affected item.

If an item is cancelled because of an error, any amount paid for that item will be refunded.

Nothing in this section permits us to avoid obligations under applicable consumer law.

21. Prohibited use

You must not use the website:

• For unlawful, fraudulent or malicious purposes.
• To infringe intellectual-property, privacy or other legal rights.
• To transmit malware, viruses or harmful code.
• To obtain unauthorised access to another account or system.
• To scrape or extract website content in a way that disrupts the store, breaches applicable law or violates our rights.
• To impersonate another person or provide deliberately misleading information.
• To interfere with website security or operation.
• To send spam or unsolicited promotional communications.
• To harass, abuse, threaten or defame another person.
• To circumvent product limits, fraud controls or other security measures.

We may restrict or suspend access where we reasonably believe these Terms have been seriously breached.

22. Suspension and termination

We may suspend or terminate access to a customer account or the website where reasonably necessary because of fraud, unlawful activity, security concerns or a serious breach of these Terms.

Termination does not affect rights or obligations that arose before termination, including payment obligations and rights relating to completed purchases.

23. Consumer guarantees and non-excludable rights

Nothing in these Terms excludes, restricts or modifies:

• The Australian Consumer Law.
• Any applicable consumer guarantee.
• Any liability that cannot lawfully be excluded.
• Any right or remedy available under applicable law.

If a provision of these Terms is inconsistent with a non-excludable legal right, the legal right prevails.

24. Website availability and limitation of liability

To the extent permitted by law, we do not guarantee that the website will always be uninterrupted, secure, error-free or available.

We are not liable for loss caused solely by circumstances outside our reasonable control or by your failure to take reasonable precautions.

Nothing in these Terms excludes or limits liability for:

• Fraud or wilful misconduct.
• Personal injury where liability cannot lawfully be excluded.
• Negligence where liability cannot lawfully be excluded.
• Breach of an applicable consumer guarantee.
• Any other liability that cannot be excluded under applicable law.

To the extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or unlawful conduct.

25. Indemnity

You are responsible for reasonable loss or third-party claims caused by your unlawful use of the website, infringement of another person’s rights or serious breach of these Terms.

This responsibility applies only to the extent the loss or claim was caused or contributed to by your conduct.

It does not apply to loss caused by NailGlow Supplies, Shopify or another party.

26. Severability and waiver

If part of these Terms is found to be invalid or unenforceable, that part will be limited or removed to the minimum extent necessary. The remaining provisions continue to apply.

A delay in enforcing a right does not waive that right.

27. Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer these Terms as part of a genuine sale, restructure or transfer of the business, provided that doing so does not materially reduce your existing rights.

28. Governing law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.

You and NailGlow Supplies submit to the courts having jurisdiction in New South Wales, subject to any mandatory right to rely on the laws or courts of another applicable jurisdiction.

29. Changes to these Terms

We may update these Terms to reflect changes to our services, business practices, technology or legal obligations.

The revised Terms will be published on this page with an updated revision date.

Where required by law, we will provide additional notice of material changes.

Changes do not retrospectively remove rights relating to purchases made before the change.
